How to Register a Yacht in Malta: Routes, Documents and Timing

Malta offers private and commercial yacht registration, plus a separate bareboat charter route. Passenger operations use a technical code within the commercial framework, while ownership, VAT, tax residence and operating permissions require separate checks.

You may be choosing the flag while negotiating the yacht itself, with delivery, financing and refit dates already moving. Start with the intended use: private, commercial, passenger or bareboat. That decision determines the registration route, ownership evidence, technical code and operational file.

The short answer

Register the yacht around its intended use, ownership and operating model. Transport Malta describes a private yacht as a pleasure yacht of at least 6 metres, not used for reward or trade, not carrying passengers for reward and used solely by the owner.

01

Fix the intended use before you choose the route

You may be choosing the flag while negotiating the yacht itself, with delivery, financing and refit dates already moving. The first decision is whether the yacht will be private, commercially operated, used for passenger service or placed into a bareboat structure. That choice drives the ownership file, surveys, certificates, crew plan and timetable.

Transport Malta states that a Malta-flag yacht may be registered as a private yacht or a commercial yacht. Its private description covers a pleasure yacht of 6 metres or more that is not used for reward or trade, does not carry passengers for reward and is used solely by the owner. Its commercial description covers a yacht of 15 metres or more, carrying no cargo, no more than 12 passengers and operated commercially by the owner or owning body corporate.

Before signing, record the yacht’s overall length, load-line length, gross tonnage, maximum passenger capacity, intended navigation area and whether anyone will pay to use it. The distinction matters because the administrative category and the technical code may use different measurements.

02

Private, commercial and passenger-code pathways

Transport Malta divides commercial registration into yachts from 15 to 24 metres, superyachts over 24 metres and below 500 gross tonnes, and superyachts over 24 metres and at least 500 gross tonnes. These are useful administrative bands, but they do not replace a route assessment based on passenger numbers, tonnage, construction, voyage profile and applicable conventions.

For commercial yachts below 24 metres, Malta’s Small Commercial Yacht Code applies and has been effective since 1 April 2024. A yacht operating commercially in another country’s territorial waters must also meet that country’s additional requirements. A Maltese certificate therefore does not, by itself, answer the coastal-state or charter-market question.

For commercial yachts with a load-line length of 24 metres or more carrying up to 12 passengers, the Commercial Yacht Code 2025 came into effect on 1 July 2025 and superseded the 2020 edition. Transport Malta’s announcement says yachts certified under the earlier code, or being surveyed to it, must transition at their first renewal survey after 31 December 2025.

The Passenger Yacht Code is a compliance framework within the commercial and passenger-vessel pathway, not a third registration category alongside private and commercial registration. It is designed for Passenger Yachts carrying more than 12 and up to 36 passengers, no more than 200 persons onboard, no cargo and international voyages. The yacht must also meet the applicable SOLAS and other convention requirements, subject to the Code’s arrangements.

03

Can a foreign owner or company register the yacht?

A Maltese company is not automatically required. Transport Malta’s current ship-registration overview says ships may be registered in the name of legally constituted corporate bodies or entities irrespective of nationality. It also identifies routes for eligible European Union and European Free Trade Association nationals; the current registration guide should be checked for the proposed individual owner’s nationality and residence position.

For a non-resident eligible owner, Transport Malta requires the appointment of a Maltese resident agent. The agent is a registration and service contact. That appointment does not, by itself, establish the owner’s Maltese tax residence, company substance, management and control or VAT treatment.

A corporate owner will need to evidence its legal constitution. Whether the chosen entity, individual, trust-related structure or ownership chain qualifies should be confirmed before signing, particularly where the structure includes non-European individuals, layered entities, lenders or a bareboat charterer.

A Maltese company may be useful for ownership, financing, administration or succession, but it is not an automatic tax answer. Company residence, substance, income, VAT, customs and private-use questions remain separate analyses.

04

Bareboat charter registration: a separate structuring route

Malta provides for bareboat charter registration of foreign ships under the Malta flag. The route can be relevant where the Maltese operational registration is needed but title remains recorded in an underlying foreign registry.

Transport Malta states that title, mortgages and encumbrances are governed by the underlying registry, while operation falls under the bareboat charter registry. The Maltese registration lasts for the shorter of the charter term or underlying registration term, and cannot exceed two years for a registration period, although it may be extended.

The file includes the charterer’s application, a declaration of bareboat charter with the charter agreement, an extract from the underlying registration, the International Tonnage Certificate and written consent from the underlying registry, owners and mortgagees. The registries must be compatible and the ship cannot be registered in another bareboat registry.

05

Prepare title and documents before closing

Transport Malta’s provisional application normally requires proof that the owner qualifies to own a Maltese yacht, the incorporation document where the owner is a body corporate, appointment of a resident agent for a non-resident owner, any applicable International Tonnage Certificate, a declaration of ownership, a radio-station licence application, commercial-code compliance where relevant and payment of initial registration fees and annual tonnage tax.

During provisional registration, the file normally expands to include a bill of sale or builder’s certificate, cancellation of the previous registry where applicable, a Certificate of Survey, the International Tonnage Certificate, evidence of lawful marking and CE documentation where applicable. A commercial yacht over 500 gross tonnes also requires the latest Continuous Synopsis Record from the previous administration.

The ownership declaration must address qualification to own a Maltese ship, construction details, the owner’s entitlement, unqualified ownership interests and registered encumbrances. For a yacht already registered elsewhere, obtain a current registry extract, verify the seller’s authority, identify mortgages and other encumbrances, and make deletion or cancellation evidence part of the closing conditions.

The registry file and the purchase closing file should be coordinated. The maritime lawyer, registration specialist, lender and surveyor should agree which documents must be available before funds are released and which may be completed during the provisional period.

06

Provisional registration and operational readiness

A yacht is first registered provisionally under the Malta flag for six months. Transport Malta allows a further period, or periods, not exceeding six months in aggregate. The certificate is subject to renewal on the anniversary of Maltese registration.

Use that period as a completion timetable: clear title and deletion documents, finish survey and tonnage work, address marking and radio requirements, settle the ownership evidence and obtain the certificates for the intended operation. If the file is not complete within the permitted period, contact Transport Malta promptly; the provisional certificate should not be treated as open-ended.

Where valid and appropriate convention certificates are not in place, Transport Malta says the yacht will be issued with a non-operational certificate of registry. Flag registration and permission to conduct the proposed commercial service are therefore separate milestones in the delivery plan.

07

Crew, classification and operating permissions

For a commercially registered superyacht over 24 metres, Transport Malta issues a Minimum Safe Manning Certificate after reviewing the application. Commercial yachts of 24 metres or less do not receive that certificate but must comply with the applicable Code’s minimum-manning requirements.

Transport Malta states that there are no nationality restrictions on the master, officers and crew engaged on Maltese yachts and superyachts. Foreign STCW certificates require Maltese endorsement recognising them; other yacht certification may be accepted case by case.

A merchant vessel must be classed with a classification society authorised to issue statutory certificates for the Government of Malta at registration and while under the Malta flag. Transport Malta’s current list includes ABS, Bureau Veritas, China Classification Society, Croatian Register of Shipping, ClassNK, DNV, Indian Register of Shipping, Korean Register of Shipping, Lloyd’s Register, Polish Register of Shipping and RINA.

The classification position should be distinguished from code-compliance surveys and from requirements imposed by a lender, insurer or charter market. Select the recognised organisation or appointed surveyor early so that survey scope, statutory certificates and delivery conditions are aligned.

If the yacht will operate in another country’s territorial waters, Malta registration does not replace local port-state, coastal-state, immigration, safety, chartering or tax requirements. The operating map should be reviewed before the yacht is advertised or accepts a charter.

08

Fees, tonnage tax and the wider budget

Transport Malta’s current fees page links to a Ship Registration Fees Calculator and to its registration-fees and tonnage-tax material. Charges depend on factors including vessel category, length and tonnage, so obtain a current calculation or written quotation for the specific yacht rather than treating an undated or older table as a fixed 2026 tariff.

The wider budget may include surveys, classification or statutory certification, resident-agent and registration services, radio licensing, legal work, crewing, insurance, yacht management, accounting and commercial certification. No authoritative source establishes a universal all-in professional cost or guaranteed processing time; those items should be quoted against the yacht and operating model.

09

Keep registration, VAT and tax residence separate

Malta registration does not, by itself, determine VAT on purchase, importation, private use, chartering or leasing. It also does not automatically establish the owner’s tax residence, corporate substance or management and control. Those questions depend on the transaction, ownership and operating facts and on the rules of the other jurisdictions involved.

Malta’s VAT guideline dated 2 November 2023 addresses qualifying pleasure-boat leasing and looks at actual effective use and enjoyment inside and outside EU territorial waters. It refers to evidence such as master’s logs and GPS or AIS data. That guidance is not a blanket exemption for Malta-registered yachts and is not a complete answer for purchase, importation, chartering or temporary admission.

Before closing, obtain written advice covering VAT and customs status, charter invoicing, private use, importation or transfer, company and owner tax residence, management and control, financing and reporting obligations. A registration agent can coordinate the maritime file but should not be treated as a substitute for tax advice in Malta and the yacht’s operating jurisdictions.

10

A practical sequence before signing

First, define the private, commercial, passenger or bareboat use case. Second, confirm the proposed owner or charterer’s eligibility and resident-agent position. Third, make the purchase contract conditional on title, mortgage, deletion, survey, tonnage, class and certification checks. Fourth, obtain current registration and annual-cost calculations. Fifth, map the commercial code, crewing and operating-area requirements before committing to a charter model, refit scope or delivery date.

The core professional team is usually a resident agent or registration specialist, maritime lawyer, surveyor or recognised organisation, yacht manager, insurance broker and tax adviser. Add a classification society where the applicable rules, lender or operating model require it. The practical question is whether the proposed yacht, owner, documents and business model can reach operational readiness on the intended date.

The certificate will show Malta as the yacht’s home port, but that does not mean the yacht must be physically berthed in Valletta or operated from Malta. Berthing, cruising, chartering and commercial permissions remain separate questions governed by the relevant local rules.

Which Malta registration route may fit?

Q&A

Questions people ask

How long does provisional Malta yacht registration last?

It normally lasts six months, with a possible further period or periods not exceeding six months in aggregate. The file should be managed against the applicable deadlines; provisional registration does not automatically authorise commercial operation.

Does a foreign owner need a Maltese company?

Not automatically. Transport Malta says legally constituted corporate bodies or entities may generally register irrespective of nationality. Individual eligibility depends on the applicable nationality and residence rules. An eligible non-resident owner must appoint a Maltese resident agent.

Is the Passenger Yacht Code a third registration category?

No. Transport Malta describes Malta yacht registration as private or commercial. The Passenger Yacht Code is a commercial and passenger-vessel compliance framework for qualifying yachts carrying more than 12 and up to 36 passengers, subject to its other conditions.

What is bareboat charter registration?

It is a separate Malta route for a qualifying foreign ship chartered to an eligible Maltese owner-type entity or person. The underlying registry continues to govern title, mortgages and encumbrances, while the bareboat registry governs operation.

When does the Commercial Yacht Code 2025 apply?

It applies to commercial yachts with a load-line length of 24 metres or more carrying up to 12 passengers. Transport Malta states that it came into effect on 1 July 2025 and superseded the 2020 edition.

What should I check when buying a yacht already registered elsewhere?

Check title and ownership authority, the current registry record, mortgages and encumbrances, deletion or cancellation requirements, survey and class status, tonnage and safety certificates, and whether the proposed Malta operating model changes the certification route.

Does Malta yacht registration create Maltese tax residence?

No automatic result should be assumed. Flag registration, ownership, resident-agent appointment, corporate substance, tax residence, customs and VAT treatment are separate questions.

For founders and decision-makers

Malta is a decision with several moving parts.

When a decision touches company formation, tax, regulation or residence, the right sequence matters as much as the destination.
