Elon Musk has agreed to settle two lawsuits filed in Austin, Texas, by Arizona residents over his 2024 promise to give $1 million a day to a randomly selected registered voter in a swing state, The Verge reported on October 17, 2026. The settlement terms have not been made public.
The plaintiffs claimed Musk falsely said the prizes would be awarded randomly. They said they would not have signed the petition required to enter had they known the drawings were not random, and they alleged that America PAC used the petition to gather user data. They also said the petition placed no limits on how that data could be used or sold. These remain the plaintiffs' allegations.
Separately, a Philadelphia District Attorney sued to stop the giveaway, arguing it was an illegal lottery. During a hearing, a representative for America PAC told the judge, as reported, that "the $1 million recipients are not chosen by chance." That statement contradicted Musk's public claim that the drawings were random.
The Verge's report does not say whether the settlement includes any admission of wrongdoing.
