2025 ECJ Ruling context: Following the European Court of Justice ruling in April 2025, Malta terminated its investor citizenship programme. Citizenship by Merit is a separate framework that has existed since 2017 under Subsidiary Legislation 188.04, now governed by SL 188.06. It is assessed on a case-by-case basis for individuals who have rendered exceptional services to Malta or humanity, under Article 10(9). It is not an investment programme and was not introduced as a replacement.

What People Get Wrong

MPRP ≠ Tax Residency
The Malta Permanent Residency Programme gives you the right to live in Malta indefinitely. It does not make you a Maltese tax resident. Tax residency is a separate status based on physical presence and domicile. If you hold MPRP but spend most of your time elsewhere, you are likely still tax resident in your home country.
MPRP ≠ Work Permit
MPRP holders cannot automatically work in Malta. To take employment, you must apply for a separate work permit through normal Identità procedures. However, you can establish a business in Malta under MPRP, subject to standard Malta company law requirements.
Schengen Rights
MPRP and MRP holders can travel within the Schengen Area for up to 90 days in any 180-day period — the standard tourist allowance. A Malta residence card does not grant unlimited EU freedom of movement. Always carry both your passport and residence card when travelling in Schengen.
