ESMA Pulls the Rope: Polymarket and Kalshi Face a Wall

Europe's top securities regulator has put prediction markets on notice. The European Securities and Markets Authority has questioned whether platforms including Polymarket and Kalshi hold the authorizations required to operate legally inside the EU, warning that event contracts may fall under existing binary-options bans, crypto-asset frameworks including MiCA, or national gambling laws, according to CoinDesk.

The intervention is significant. Prediction markets have spent the past two years positioning themselves as the credible alternative to polling — Kalshi's U.S. election calls outperformed most newsroom models in 2024. But ESMA's message is that credibility in the market does not equal authorization in the jurisdiction.

The regulator did not issue formal enforcement action. It issued something more uncomfortable: a question. That question now sits on the desks of every compliance officer at every exchange running event contracts with European users, and the clock is running.

For OKX, which has separately begun offering leveraged bets on private-company valuations — including positions tied to OpenAI and Anthropic — the timing is pointed. Europe is the prize market. ESMA just made clear it intends to decide who gets to play there.

The platforms have not publicly responded. That silence will not hold long.
