When Deel acts as EOR, Deel is the legal employer of record — not you. Employment disputes, termination complications, tax errors in a foreign jurisdiction: Deel's liability, not yours. They have skin in the game because their name is on the contract.
Gusto processes your US payroll and files your taxes. Compliance errors are still ultimately your responsibility — Gusto helps you stay compliant, but as a service provider, not as the employer. The legal risk stays with your entity.
For international employment, Deel's EOR model transfers meaningful legal risk away from you. That is worth the premium over a payroll processor that does not take on employer liability.

The real cost
Price vs total cost
Deel EOR starts at $599/employee/month. Expensive on paper. But compare it to: legal fees to set up a local entity ($5,000–$20,000+), accounting costs to maintain it, the risk of a misclassification lawsuit. The $599 is a known, bounded cost. The alternative is unbounded.
Gusto starts at $6/employee/month plus a base fee. For US payroll, outstanding value. But if you try to use Gusto for workers who should legally be on an EOR, you are not saving $593/month — you are accumulating liability that will cost far more when it surfaces.
Compare costs within the correct use case. Gusto is better value for US payroll. Deel is better value for international employment. Comparing them cross-purpose is like comparing the cost of a visa to the cost of a plane ticket.
